This article explains the implications of the changed policy and provides suggestions from tax, HR, and legal perspectives.<\/p>\n<p><strong>What are the tax-exempt benefits-in-kind?<\/strong><\/p>\n<p>Non-China domiciled individuals working in China can currently enjoy tax-exempt benefits-in-kind, including the below eight categories:<\/p>\n<p>1.Housing expense<\/p>\n<p>2.Education expense for children<\/p>\n<p>3.Language training expense<\/p>\n<p>4.Meal fee<\/p>\n<p>5.Laundry fee<\/p>\n<p>6.Relocation expense<\/p>\n<p>7.Business travel expense<\/p>\n<p>8.Home leave expense<\/p>\n<p><img decoding=\"async\" class=\"alignnone wp-image-4345 size-large\" src=\"https:\/\/www.elitestage.cn\/wp-content\/uploads\/2021\/09\/long3-1024x680.jpg\" alt=\"\" width=\"1024\" height=\"680\" srcset=\"https:\/\/www.elitestage.cn\/wp-content\/uploads\/2021\/09\/long3-1024x680.jpg 1024w, https:\/\/www.elitestage.cn\/wp-content\/uploads\/2021\/09\/long3-300x199.jpg 300w, https:\/\/www.elitestage.cn\/wp-content\/uploads\/2021\/09\/long3-768x510.jpg 768w, https:\/\/www.elitestage.cn\/wp-content\/uploads\/2021\/09\/long3-16x12.jpg 16w, https:\/\/www.elitestage.cn\/wp-content\/uploads\/2021\/09\/long3-150x100.jpg 150w, https:\/\/www.elitestage.cn\/wp-content\/uploads\/2021\/09\/long3-80x53.jpg 80w, https:\/\/www.elitestage.cn\/wp-content\/uploads\/2021\/09\/long3-620x412.jpg 620w, https:\/\/www.elitestage.cn\/wp-content\/uploads\/2021\/09\/long3-460x305.jpg 460w, https:\/\/www.elitestage.cn\/wp-content\/uploads\/2021\/09\/long3-365x242.jpg 365w, https:\/\/www.elitestage.cn\/wp-content\/uploads\/2021\/09\/long3.jpg 1080w\" sizes=\"(max-width: 1024px) 100vw, 1024px\" loading=\"lazy\" \/><\/p>\n<p>Such benefits-in-kind could be exempt from PRC IIT provided that the expenses are reasonable in amount and there are corresponding supporting documents, such as invoices (fapiao), for each expense. In addition, there are some specific requirements for each category. For example, for home leave expenses, only the travel expenses for the expatriate themself from China to their\/spouse\u2019s home country for up to two trips per year could be exempt from IIT.<\/p>\n<p><strong>Three-year transition period for\u00a0<\/strong><strong>non-China domiciled tax residents<\/strong><\/p>\n<section>However, with the country&#8217;s new\u00a0IIT Law\u00a0taking effect from January 1, 2019, the government has considered rolling back the tax exemption on special benefits-in-kind for foreigners, partly in a move to equalize benefits between local and foreign tax resident workers.To ensure a smooth policy transition, at the end of 2018, the Ministry of Finance and the State Tax Administration jointly announced the\u00a0Notice on the Preferential Policy Convergence Problem\u00a0(<em>Cai Shui [2018] No.164<\/em>).The Notice introduced a three-year transition period. From\u00a0January 1, 2019 to December 31, 2021, non-China domiciled tax residents (who do not have a domicile in China and live for 183 days or more in China in a given tax year) can choose to enjoy:1.The tax-exempt benefits-in-kind;<\/p>\n<p>2.The six additional itemized deductions.<\/p>\n<\/section>\n<section>\n<section>\n<section><\/section>\n<\/section>\n<\/section>\n<section>\n<section>\n<section>\n<section>\n<section>\n<section>To be specific, the six additional itemized deductions include:1.Children&#8217;s education expenses<\/p>\n<p>2.Continuing education expenses<\/p>\n<p>3.Housing mortgage interest<\/p>\n<p>4.Housing rent<\/p>\n<p>5.Healthcare costs for serious illness<\/p>\n<p>6.Expenses for taking care of the elderly<\/p>\n<p><img decoding=\"async\" class=\"alignnone wp-image-4346 size-large\" src=\"https:\/\/www.elitestage.cn\/wp-content\/uploads\/2021\/09\/long4-1024x683.jpg\" alt=\"\" width=\"1024\" height=\"683\" srcset=\"https:\/\/www.elitestage.cn\/wp-content\/uploads\/2021\/09\/long4-1024x683.jpg 1024w, https:\/\/www.elitestage.cn\/wp-content\/uploads\/2021\/09\/long4-300x200.jpg 300w, https:\/\/www.elitestage.cn\/wp-content\/uploads\/2021\/09\/long4-768x512.jpg 768w, https:\/\/www.elitestage.cn\/wp-content\/uploads\/2021\/09\/long4-16x12.jpg 16w, https:\/\/www.elitestage.cn\/wp-content\/uploads\/2021\/09\/long4-150x100.jpg 150w, https:\/\/www.elitestage.cn\/wp-content\/uploads\/2021\/09\/long4-80x53.jpg 80w, https:\/\/www.elitestage.cn\/wp-content\/uploads\/2021\/09\/long4-620x413.jpg 620w, https:\/\/www.elitestage.cn\/wp-content\/uploads\/2021\/09\/long4-460x307.jpg 460w, https:\/\/www.elitestage.cn\/wp-content\/uploads\/2021\/09\/long4-365x243.jpg 365w, https:\/\/www.elitestage.cn\/wp-content\/uploads\/2021\/09\/long4.jpg 1080w\" sizes=\"(max-width: 1024px) 100vw, 1024px\" loading=\"lazy\" \/><\/p>\n<p>The two policies cannot be simultaneously enjoyed by non-China domiciled tax residents during the transition period. And once decided, non-China domiciled tax residents cannot change their preference within a given tax year.<\/p>\n<p>According to the Notice, after the three-year transition period, that is\u00a0starting January 1, 2022, non-China domiciled tax residents will no longer enjoy preferential tax-exemption policies on benefits-in-kind, including housing, language training, and children&#8217;s education.<\/p>\n<p>Instead, the three categories of benefits-in-kind will be replaced by the corresponding additional itemized deductions (that is, housing rent, continuing education expenses, and children&#8217;s education expenses).<\/p>\n<p>However, as to the remaining five categories of benefits-in-kind (namely meal fee, laundry, relocation expense, business travel expense, and home leave expense), the policy has not clarified whether they may continue to be tax-exempt.<\/p>\n<\/section>\n<\/section>\n<\/section>\n<\/section>\n<\/section>\n<\/section>\n<\/section>\n","protected":false},"excerpt":{"rendered":"<p class=\"tx-excerpt\">&nbsp; Starting next year, foreigners working in China may no longer be entitled to some tax-free fringe benefits (for example, housing rental, children&#8217;s education costs, and language training costs).
